Abstract

Kharis Pujianto, 41182941160009 THE CONCEPT OF JUSTICE IN POLYGAME ACCORDING TO MUHAMMAD SYAHRUR. Thesis. Bekasi Department of Ahwal Al-Syakhshiyyah Islamic University "45" Bekasi, 2023. Polygamy is a form of regulation that existed long before Islam. Polygamy has existed since ancient times in human life in various social groups. Usually polygamy is practiced by people in power or warlords. The polygamy tradition at that time was used as a form of one's power. Many kings had many wives and concubines. This was common practice by previous people before Islam. The Jewish nation is a nation that has no rules in determining the number of wives. Likewise with the Christian nation, in their Bible, there is no clear explanation about the rules of polygamy. This research is library research. In this case the data to be examined is a book of the Al-Kitab wa al-Qur'an Qira'ah Mu'ashirah, using a qualitative approach. In this study using the documentary method technique. The data analysis technique used in this study is an analysis patterned on the deductive method. This method is used to analyze the concept of fairness in general and then draw specific conclusions. In the case of polygamy Muhammad Syahrur does not reject the existence of polygamy, in fact he strongly acknowledges the validity regarding the issue of polygamy which has been stated in the holy book of the Qur'an in surah An-Nisa verse 3. In view of this verse Muhammad Syahrur sets limits on determining quantitative laws and limitations qualitative legal determination. Quantitatively, polygamy is permissible if at least one woman is married and the maximum is limited to 4 women, while qualitatively Muhammad Syahrur is of the opinion that the first wife is permissible whether the woman is a girl or a widow, and for the second wife onwards (wife 4th) must be a widow whose husband has died and still has young children.
