Abstract

The divorce rate in Indonesia continues to increase due to various causes, such as domestic violence, polygamy, ongoing disputes, and economic problems. Society generally understands domestic violence only as physical acts, whereas forms of violence through hurtful speech or words also have serious psychological impacts on victims. This research analyzes the Bekasi Religious Court Decision Number 4027/Pdt.G/2024/PA.Bks which granted a divorce petition based on verbal abuse. The method used is an empirical juridical approach through interviews, observations, and library research to collect primary and secondary data. The study findings show that the Respondent committed verbal abuse repeatedly and systematically against the Petitioner, causing irreparable psychological distress. The panel of judges' considerations in this decision align with the dharar principle that prohibits harmful actions and the maqasid syariah concept that protects human life, dignity, and honor. The judges assessed that maintaining the marriage would actually cause greater harm, making divorce the most beneficial solution. This research affirms that Islamic legal protection is not limited to physical aspects alone, but also encompasses the psychological and emotional well-being of verbal abuse victims.
