Abstract
Nurullia Diani Maulivi, 41182941190007. POLYGAMY CONDITIONS IN TURKISH AND INDONESIA FAMILY LAW REGULATIONS (Horizontal, Vertical, and Diagonal Legal Comparative Study), Ahwal Al Shakhshiyyah Study Program, Islamic University "45" Bekasi. (1445 Hijri / 2023 AD). The objectives of this research To find out the comparison of the legal provisions of polygamy in the legislation of marriage law in Turkey and Indonesia, To find out the differences and similarities of polygamy provisions in Turkish and Indonesian legislation, and To find out the shift of polygamy provisions in Turkish and Indonesian legislation from the concept of polygamy that has been formulated in madzhab fiqh. This research is a type of literature research (Library Research), namely research based on library materials and in the form of literature theories related to the problems to be studied. The results in general are: 1) The legal provisions of polygamy in the provisions between Indonesia and Turkey have similarities and differences. Both adhere to the principle of monogamy and punish violators, but in Indonesia it does not apply absolutely. 2) The difference is that Indonesia complicates the practice of polygamy as stipulated in Article 4 and Article 5 of Law No. 1 of 1974, while in Turkey it is prohibited and sanctions are given for violations, namely stipulated in Article 8 of The Turkish Family (Marrage And Divorce) law of 1951 and articles 93 and 112 (1) The Turkish Civil Code 1926. 3) The researcher analyzes the legal comparison of these two countries from three aspects, namely, Horizontal, Vertical and Diagonal.
