Abstract

Adam Firdaus Habibi NPM 41182941190002. ANALYSIS OF ISLAMIC LAW IN MARRIAGE AND DIVORCE CLAIMS CUMULATED CASE (Study of Decision Number: 0369/Pdt.G/2021/PA.Bks.) Ahwal Al-Syakhshiyyah Study Program, Faculty of Islamic Religion, Islamic University “45” Bekasi, 1445H/2023M. This thesis aims to find out the basic considerations of the Panel of Judges in the Bekasi Religious Court Decision Number 0369/Pdt.G/2021/PA.Bks in deciding cases of constituting marriage and contested divorce. And to know the basis of Islamic law on the decision. This research uses a type of normative qualitative research, using a statutory approach (Statue Approach) and a case approach (Case Approach) to then be studied from various legal aspects that have to do with legal issues (legal issue) and refers to legal norms that contained in laws and regulations and court decisions. Data collection techniques in this study were carried out through observation and documentation methods by directly observing a certain object with the aim of obtaining some data and information related to the object from written sources or documents. The results of this study indicate that, in the Bekasi Religious Court's decision, the panel of judges granted the request for approval of marriage and contested divorce on the grounds that the marriage complied with the provisions of Islamic law and there were no obstacles to marriage and divorce according to Law Number 1 of 1974 Jo. concerning Marriage which has been amended by Law No. 16 of 2019. The judge's efforts to grant the marriage certificate are rukhsah. Meanwhile, granting a divorce is for the sake of benefit. Keywords: Islamic Law, Marriage Isbat, Divorce.
