Bekasi: Departement of Islamic Family Law. Faculty of Islamic Studies. Islamic University “45” Bekasi, 2023. Death is an event that will be experienced by everyone, and from the event of death it creates other events such as inheritance. Inheritance is a legal event as a result of death. Inheritance is a series of complex discussions that contain various legal rules that exist in the world, because inheritance is carried out in all corners of the world with various rules respectively. The implementation of inheritance applies according to the legal provisions adhered to by the perpetrator himself. Customary inheritance law in Indonesia occupies an important position in the applicable legal regulations. Waringinjaya Village is one of the areas where many residents still apply inheritance law with a parental system, although this provision is not fully implemented. The problems that will be discussed in this study are how the application of inheritance law with the parental system in the village of Waringinjaya and how the concept of maslahah examines phenomena like this. This type of research is Field Research or field research or empirical research, because of which the object under study is in the field and the function of empirical research is to analyze law which is seen as patterned social behavior in people's lives that always interact and relate to social aspects. Therefore, this research is hereinafter referred to as Sociological Legal Research (Socio Legal Research). This study aims to describe reality in accordance with the phenomenon in detail and thoroughly, as well as collect data from natural settings by utilizing the researcher as a key instrument as a peeler of the problems to be studied. This study uses qualitative research methods in a research activity, so that more comprehensive, valid, reliable and objective data will be obtained. Where this research seeks to describe systematically so as to produce factual data regarding benefits in the practice of dividing inheritance in Waringinjaya Village with a parental system. From the results of the research, the implementation of the distribution of inheritance in the parental system in Waringinjaya Village in general, there is conformity to the benefit according to the concept of religion as well as according to the social concept of society. From this presentation, it can be concluded that the rules for dividing inheritance in Waringinjaya Village are in line with the objectives of the concept of maslahah in Islam, namely bringing benefits and rejecting damage.
